Watching the latest scandal unfold at the Wayne County BOE.

My thanks to those who emailed this blog and gave me the heads up to look at
.
Geez, what a resource.
Lots and lots of local community stuff/info...while some subjects
on there are certainly personal/mean/profane/confusing,
the various BOE-related topics are very informative.
And based on the BOE topic that's on there most recently
I must say ... my, my, my.
Those fellas certainly do stay busy out there at the Central Office.

I don't think this is what the WVDE and Gov. Manchin mean by
"Technology Integration"


Speaking strictly from a technology point-of-view, perhaps we need an in-service presentation to Wayne County BOE employees on the quickly growing problem of
"Sexting In The School Environment"

Evidently, we have some experts on staff.

Oh, and even better, instead of having it here (FREE)
at one of our high schools in Wayne County,

let's see ... let's have it 2 or 3 hours away ... in Lewis County.
And instead of a school, we could have it at the Stonewall Jackson Resort up there.
And have everyone in Wayne County drive 150 miles up there.
Then have them drive another 150 miles back.
And pay them mileage. And pay for their meals.
And pay for them to spend the night. No, let's make that two nights.

There's some Fiscal Responsibility for you.
Our Taaaax Dollars hard at work.

Resolutions:
To See To it That:
  • The Wayne County Board of Education holds Superintendent Gary Adkins and Assistant Superintendent Mike Rutherford and any other Central Office personnel who were involved, accountable for their role in the multiple instances of nonfeasance, misfeasance and malfeasance as regards questionable payments to and multiple incidents involving Todd H. Thompson, former Network Administrator for Spring Valley High School and son of long-time Wayne County Board of Education Member, Rodney Thompson, D. C.; specifically requesting that Mr. Adkins' employment be terminated, and Mr. Rutherford's employment be terminated.
  • The Wayne County Board of Education re-examine all positions, new or existing, that have been filled under Mr. Adkins tenure with close scrutiny as to improper procedure, lesser qualified personnel chosen over more qualified personnel and also, particularly, creation of unnecessary positions.
  • The Wayne County Board of Education fulfill its fiduciary responsibility to be good stewards of the public funds with which they have been entrusted and drastically reduce Central Office personnel and associated costs;
  1. thus allowing necessary teachers to be provided to all of the schools that have begged for them over and over, year after year, only to be told there is no money
  2. thus allowing necessary supplies, equipment and classroom materials to be provided to all of the schools that have had to do fundraisers all year long to purchase things that should have been supplied by the school system, only to be told there is no money
  3. thus allowing necessary maintenance, repairs, and replacement of heating & cooling, bathrooms, roofs, ovens, intercoms, phone systems, security systems, doors, etc. that schools have requested, only to be told there is no money

A Note to All Concerned:

Be assured that we remember the past.

One More Definition:

Resignation in Wayne County: means Freedom. Freedom to be hired with no scrutiny, no rules, no boundaries, paid whether you show up or not, paid whether you work or not.


1) Freedom to be re-hired as a teacher. Tomorrow. In a school. In a classroom. Everyday. With kids.

2) Freedom to be hired as an Outside Contractor. For where? Could be Central Office, any school, all schools. With access everywhere, to schools, to everyone's personal information - employees or students, AmberAlert photos, the new lunch-line fingerprint database, social security numbers. Or a Contractor could work from home. There's something that makes you go hmmmm. Who checks their hours? Who knows? Who checks? But they are paid. Someone's signature is on something. Whose signature(s) is it? And payments to Outside Contractors won't be listed in the newspaper. They aren't payroll. Nobody knows who's employed, who approved it, how much they are paid, what they're supposed to be doing, or if they did it.

3) Freedom to be hired as a federally funded Title I "Coach" or "Consultant". Wonderful work if you can get it. For years, we had a few, very good "coaches". They were experienced, wonderful mentors, spent every hour in the schools, in classrooms, with kids, with teachers. We now have more "Coaches" and "Consultants" being hired. Did we actually pay someone $1000 a day? Might be a little champagne on a beer budget there. Even if they're good. And we have made progress on test scores and AYP. Still, there's been at least one that's had attendance issues. For a long time. Paid whether they show up at a school or not? Paid even if they're doing "non-numeracy" things? Might be a good idea to get at least that one off the payroll. And certainly not hire anyone else with "issues" or worse.

The Board Has Spoken.

BUT

THEY HAVE NOT:

- Answered one question.

- Fulfilled their duty to pursue termination of a dangerous employee.

- Acted to protect our children.

- Explained their actions.


They have accepted Mr. Todd Thompson's resignation.


WHYWHYWHYWHYWHYWHY


WHY WAS THIS EMPLOYEE ALLOWED TO RESIGN WHEN OTHERS HAVE BEEN TERMINATED?

WHY DOES HE GET TO KEEP HIS TEACHING LICENSE?

Board to SVHS: (condensed & paraphrased) 'SVHS football is great. Although my kids go to Wayne to play football, we should all get behind the new coach and support SVHS football.'

SVHS to Board: Thought we were.

Glad to see the Board continues their great tradition of having their priorities in order.

Perhaps they should ask our football players what they think the Board should do about Mr. Todd Thompson.

They certainly don't seem to want to hear what the parents of our football players think they should do about him.

The journey to a much more comprehensive solution begins.

Important Note to Parents & SVHS Staff:

The Board of Education will be at SVHS for a meeting this Thursday, November 13, 2008 at 6:30 to receive reports on school achievement from the LSICs for Buffalo/Ceredo/ Kenova/Kellogg/ Elementary Schools, Buffalo/Ceredo-Kenova/Vinson Middle Schools and Spring Valley High School. This meeting was previously scheduled, long before the Superintendent returned Mr. Thompson to SVHS.

This meeting should be considered, by law, to be an official meeting of the Wayne County Board of Education and regular business should be conducted, including receiving delegations from schools who wish to be heard. Regular business, including personnel matters, was conducted at the most recent WCBOE meeting held October 23, 2008 at Tolsia High School, where the LSICs from several area schools made reports to the Board.

News media will be present at this meeting.

It is important for all concerned parents to be aware that photos of SVHS students were taken, without the knowledge or authorization of administrators or parents, and posted to a private internet site last year, again without authorization, and posted again to a private internet site, again without authorization and with direct insubordination approximately three weeks ago.

The SVHS LSIC requested multiple times the return to parents of all photos of past and present SVHS students in all forms that exist, including prints and any and all digital forms, including those stored on any type of storage media or on hard disk.

The requests were denied. In fact, the Superintendent of Wayne County Schools, Mr. Adkins, stated in May 2008 that all photos had been destroyed. This statement was proved false by the recent re-appearance of several photos which were again posted to the same private internet site, without authorization, during October 2008, by Mr. Todd Thompson.

This is my response to a Comment from a person posting with a fake identity, calling himself "JD":

Been waiting on you to show up, JD.

And let's be clear, my name is Karen Rucker and I post here as Truth-In-Education.

And let's be very clear, you are definitely no JD that I am acquainted with and your blog profile is completely blank except for the two initials. So if we're talking semantics, it is your post here and your comments that would best be described as deceptive.

So, let's talk about the truth.

It is indeed sometimes hard to look at.

Pure and unvarnished and shocking.

So,

If you consider posting the truth to be inflammatory,
If you consider posting the truth to be malicious,
If you consider posting the truth to be abusive,
If you consider posting the truth to be vilification,
If you consider posting the truth to be defamatory,

So be it.

As regards my behavior in this matter, I and others involved in this have tried to follow every protocol, every rule of procedure, beginning during the last school year, without publicity. Those who know me, know I am not a malicious or abusive person. Those adjectives could definitely be used in describing what the students and staff at this school have endured, though. Neither I, nor anyone on the Spring Valley side of this, chose this path or it's timing. And there is nothing on the face of this earth that can reduce the validity of the truth.

Thank you for your analysis of the best way to resolve this situation and your definition of hysteria. Let me reassure you that none of the hundreds of people that have spoken to us personally at school, at ballgames, at the gas station, at the grocery store, at the mall, at WalMart, at McD's-BK-Wendy's..., that have commented on this site, or have sent emails are the least bit hysterical. They have expressed disgust, amazement and some anger. Mostly they have expressed solidarity and resolve as to the efforts to pursue the termination of Mr. Thompson and the removal of others complicit in this mess. No hysteria. No extreme emotion. Just a lot of good old-fashioned Wayne County backbone out there.

As for your additional analysis of the "only way this can be resolved to anyone's satisfaction is legally" and they must "rely upon the law and the law enforcement agencies to investigate and take action!" -----I would say 1) be careful what you wish for and 2) the last person terminated in this county and several others were terminated with no criminal charges pending and indeed no criminal investigation. Well, maybe that's not the best example - the Superintendent gave the last guy his job right back. Well, maybe that will get a higher-up-the-food-chain looksee soon.

As far as my motives, you're the first to question them. Short answer: I am a Mom, You and Yours put my kid in harm's way. And my friend's kids. And my friends that work at that school. Didn't want this fight, but you brought it to my door. And a few other doors. Do believe me when I say that I am SO not saying exactly what I would like to say here - the "issue at SVHS" is NOT being used as a "retaliatory weapon to slam the Central Office Administration and the Board of Education". IT IS NOT A FLIPPIN ISSUE, IT IS THE SAFETY OF OUR KIDS. Talk about not seeing the forest for the trees.

And since you are posting here, freely speaking, with your fake name, non-censored by me, as an advocate for the "Central Office Administration and Board Attorney and Board of Education", then I will assume you are privy to the full story on this situation and other workings of the Central Office. If we agree that is the case, then you know I have chosen not to post massive additional amounts of info here that would be of a more sensational nature, both about the Thompson situation and the daily happenings at the Central Office.

I was advised in March to pursue dismissal of Mr. Thompson based on violations of the morals clause in his contract disrupting the learning environment. I chose instead to leave that mess behind, and to pursue the harassment and abuse of students and staff, violations of the safe schools act, hostile work environment, and multiple violations of both the WVDE and Wayne County Acceptable Use of Internet policies because I had WV Case Law and Grievance Board precedent handy. And yes, the hard evidence you speak of. Signed. Delivered. More than enough. It never occurred to us those would be ignored. So the comment that the "Administration and Board of Education have been working diligently on this issue" is a little disingenuous. I am sure they are now working diligently but not as an advocate for SVHS. Or this would have been over. But we're past that now. We'll let that someone a little further up the food chain decide if the items that have come before them should have been ignored. And look at the actions, and inaction, of ALL concerned, Board included.

So let's talk about New Truths. New Hard Evidence. New infractions. By Mr. Todd Thompson. In the last two weeks.

I'm sure you're very familiar with these. Let's talk about re-violations of the WVDE and Wayne County Acceptable Use of Internet policies by Mr. Todd Thompson. And Insubordination for the re-offense. Caught. Posting those bogus SVHS pages again. On a private internet service provider. With the "share my interests? just want to start a correspondence? contact me at --" page. And the page with the unauthorized pictures of SVHS students that he "copyrighted". Caught. Again. Turned in by a parent. Who kept looking. Who never let her guard down. And conveniently, Assistant Superintendent, Mike Rutherford was right there to.........suspend and recommend termination? Well no, he just told him to take it down. Like to see the incident report he wrote up on that one. Oh right, there isn't one. But there were witnesses. And the complaining parent. And another parent who printed the complete set of webpages complete with date viewed on them, just before the website was taken down. Sounds like hard evidence to me.

But there's more. Let's look at a complaint filed by an SVHS teacher on behalf of a frightened student on Monday, October 27, 2008. And said complaint delivered into the hands of ...again ... Mike Rutherford, Assistant Superintendent ... conveniently on the scene at SVHS that Monday with the Superintendent of Schools, Gary Adkins, and other Central Office Staff. An additional, important fact: the unhappy father of that student was at SVHS on Friday talking to the principal. And the unhappy father contacted a lawyer before he met with the principal. Oops. Lawyer alert.


As far as me "continually adding to the emotional instability surrounding this situation and the unstable learning environment for all concerned at SVHS" , no one's heard a peep from me since I and another SVHS parent spoke to Mr. Adkins, Mr. Rutherford, Mr. Lycan, Mr. Conzett, and the Board of Education Members in attendance during Executive Session, Wayne County Board of Education meeting held on June 3, 2008. Not a peep. Until Tuesday, October 21, 2008. Until Mr. Gary Adkins, supported by at least four members of the Wayne County Board of Education, chose to send Mr. Todd Thompson back to work as Network Administrator at Spring Valley High School. I wrote one letter. Mailed five copies to five Wayne County Board of Education members, Thursday, October 23rd, at approximately 5: 35 p.m. Received a very brief phone call from the Superintendent of Wayne County Schools the next day. Then it was off to the media and posting letters to this blog so the public has complete access, at least to our records. And our actions.

So

Let's vote. Tomorrow is election day. Let's have every single student, parent, teacher, staff member, and administrator from SVHS vote on just who they think is "continually adding to the emotional instability surrounding this situation and the unstable learning environment". Based on the feedback we've been getting in the last two weeks, maybe we should have the entire County vote on that question. I don't think my name would be the one they'd come up with.

Interestingly, you chose to mention "violating another individual's rights". Mr. Todd Thompson was very interested in individual rights, also. He mentioned his perceived "violations" of his "constitutional rights" over and over and over in an alarming, threatening email he sent back in February which I happen to have a copy of. My perspective is a bit different. I think some rights got violated, but they sure weren't Mr. Todd Thompson's. Those students, those teachers, that staff, had a right to a safe school environment, a non-hostile workplace, freedom from harassment, freedom from disruptions to learning, freedom from fear. Those are the rights I'm concerned with.

To your lecture on my "ethical obligations" and your legal opinion that I "do not have the right to use this blog and hide behind the freedom of speech" my response is I DON'T HIDE. Never Have. Never Will. You on the other hand...

As far as your advice to me about letting others know about the problems I've encountered "with accuracy, restraint, patience, and great care"

Bill,

To answer your specific question -

Everyone's top concern is the safety of the students at Spring Valley. Period. There's also the very real issue of the safety of the administrators, faculty & staff there. Unfortunately, that's not the only concern. There are so many.

As regards the numerous, more or less continuous, infractions over a long period of time, any one of which Mr. Thompson could have and should have been terminated for - the infractions that involve students and photos of students, actively seeking both positive and negative interaction with students which is certainly not appropriate to his job, and frequent unstable, angry, threatening behavior and the appearance of being under the influence while on campus are certainly intense issues, too.

I think everyone fears the obvious - an attack on or at the school by a mentally unstable person. My deepest fear though is what might happen if a parent or even a student feels provoked or threatened enough to take matters into their own hands. No matter how justified, think of the tragedy that would fall upon that person or that family. The community. They would never be the same, their lives would be ruined, changed forever.

And essentially, because a bunch of big-feeling suits sitting on a hill chose over and over not to act. And I do mean over and over. The situation with Spring Valley is small potatoes to them, the tip of an iceberg when you look at the bigger picture of the current situation at the Central Office and with the Wayne County Board of Education.

This community, and every community in our entire County, are so used to things being wrong. You become numb to it. People fear for their jobs. Grievance procedures become irrelevant if everyone is afraid to use them. The entire system is flawed, fatally in my opinion. Some things are just wrong, freestanding, and should be remedied, independent of an individual having to push an issue. This extends far past the issues at Spring Valley.

Perhaps the Central Office has always been a "way of life", an odd highly-entitled mentality/mind-set, a little prone to perks & graft & favors & retaliations rather than the best, brightest, hardest working people getting moved into the most crucial positions, not to say there aren't good people working at Wayne.

Everyone knows someone or has family or friends who work for the Board of Education. It is a family thing. And that can be a great thing. Our schools are kept running by people who have known three or four generations, front and back. So many good people. Good at their jobs. Working hard every day. But I have had person after person, some retiring sooner than they would have, from all over the county, people I've known a long time, say this is the worst they have ever seen in their 30, 35, 40 years in the system, incredibly flagrant, arrogant, heavyhanded abuse of power, hiring, trips, spending, spending, spending, cover-ups, countywide.

I think it is very simple. No one in the county wants that much. They simply want the people they have elected and especially the people whose salaries they pay with their tax dollars, to do the right thing. And if there's any question, I think the people of Wayne County would be glad to let them know exactly what the right thing is, any given day.

Announcement by the SVHS Principal made to SVHS Office Staff at 3:40 p.m. with the permission of Gary Adkins, Superintendent of Wayne County Schools:


"I have received a phone call from Mr. Adkins, the Superintendent of Schools. Mr. Adkins says that, and I wrote it down so I would be sure, Mr. Thompson has agreed to relinquish his position at Spring Valley High School because of the compassion he has for the students, staff and the community."


Hmmm. Feels like ..........DEJA VU.
What month is this? Is it April? May?
No termination? No resignation?
Relinquish? Verbally Relinquish?
Right.

Relinquish equals "BAD PENNY" Syndrome. Where will Mr. Todd Thompson turn up 5 months from now? 5 weeks, 5 days from now? Back at Spring Valley? Been there. Done that.

Maybe Wayne Middle. There's a vacancy there - he could use the suspended guy's computer.

How about Tolsia? Let's see. Yes. Looks good. Spring Valley definitely not the only school in Wayne County with teacher troubles. Mr. Thompson could pop up there, sent by the Superintendent, even if he's terminated. Is this the only school in the state of West Virginia where you can terminate a teacher (which revokes his license to teach), then re-hire him as a substitute on the same night, same Board Meeting (Joshua Wellman, English 9 -12, Tolsia High, Recommended Personnel Matters, Board Approved, Date: September 2, 2008, Gary L. Adkins, Superintendent)? Is this legal? Some interesting public documents there.


Is there any doubt that Mr. Todd Thompson will pop up somewhere else? Courtesy of our Superintendent of Schools. And evidently our Board. He was a librarian before his Spring Valley job. Can you imagine him back at a school as the librarian? The Superintendent might decide elementary schools finally get that full-time, paid librarian/sysop they've been asking for every year. Or at least one elementary school might get one special someone.


Extra Info: The Tolsia story actually gets better: The Superintendent of Schools, Mr. Adkins, sent the terminated English teacher right back to the same school he was terminated from. Next day. Personally appointed. Not even sent to a different school. Evidently quite a surprise to those at Tolsia. Everyone knew he had been fired. Someone had already been hired for his old job and was occupying his old classroom, teaching English since the first day of school. No additional English teachers required or needed. Usually that just means they'll create a fake job, then appoint the favored person. Then the Assistant Superintendent, Mr. Rutherford, is available for the on-the-scene cover-ups, as needed or take the ensuing complaints by phone. This particular situation seems to be a work-in-progress. Didn't even create the fake job before they sent him. Getting sloppy. No job specs. No job bid, posted within the required amount of time. But he's still back. Among the students. That he was removed from. Teaching. Or at least there. Getting paid. But definitely with a revoked certificate. Or maybe he's a new "Literacy Coach", paid out of the Title I Slush Fund. That would be better. He wouldn't even have to show up at the school. He could join all those other phantom employees listed at the schools, diluting the teacher-student ratio on all those official reports.


Where-O-Where is the WVDE when you need them? OEPA?
WVBOE? Anybody.
ANYBODY OUT THERE ???

Is it any wonder why students are afraid to speak up about a Wayne County School employee?

Do we not teach our children - TELL, TELL, TELL - no matter what TELL??

OK. HERE WE GO - More Info:
There was indeed a suspension on the "RECOMMENDED PERSONNEL MATTERS" Board Approved, Date: October 28, 2008 list from Tuesday's Board meeting. Not Mr. Todd Thompson, but someone else at another Wayne County school. Preliminary info indicates this suspension may be related to a violation of both the WVDE and Wayne County Safe & Acceptable Use of Internet policies.

When did they discover this employee's offense? Was it before Mike Rutherford's discovery on Thursday, October 23, 2008 of Mr. Todd Thompson's violation (again) of WVDE & Wayne County Acceptable Use of Internet polices by his re-posting multiple bogus SVHS webpages containing unauthorized photos of current and former SVHS students and soliticing inappropriate contact with minors and/or students via his WVNET access email?

OK. The CLOCK's ticking on that.

TICK. TICK. TICK.

The Superintendent must act. The Board must act.

The next Board Meeting is not until (Thursday) November 13th! It is supposed to be the big (once a year meeting) where all the LSICs from all the local elementary schools, middle schools, and SVHS (8 schools total) meet and the principals give their "Our School is Doing Great" reports to the Board.

Time To Take A Stand
The following letter was mailed to the five members of the Wayne County Board of Education on Thursday, October 23, 2008:

We vehemently protest the return of Mr. Todd Thompson, the son of a Wayne County Board of Education member, to the position of Network Administrator at Spring Valley High School.

Although presented with well-documented, multiple instances of Mr. Todd Thompson’s inappropriate and dangerous behavior and actions toward students, parents, administrators, faculty & staff, the Wayne County Superintendent of Schools, Gary Adkins, has insisted on Mr. Todd Thompson’s return to Spring Valley High School, creating once again, an unsafe and hostile environment for students, administrators, faculty & staff, parents and community, certainly non-conducive to learning and definitely a hostile work environment for the administration, faculty & staff.

It is particularly ironic that he has been returned just as the County is spending thousands of dollars to bring the Columbine High School tragedy-based “Rachel’s Challenge” Program back to Spring Valley and Wayne County schools this week. The effect of Mr. Thompson’s return upon the students, faculty & staff at this school is visible, the tone and atmosphere of the school is one of fear, anger & disbelief; creating distraction and certainly disrupting the learning process.

Therefore:

We protest the past intervention of Superintendent Gary Adkins and Assistant Superintendent Mike Rutherford, again and again, showing preferential treatment and lack of disciplinary action toward Mr. Thompson for multiple egregious acts that merit a recommendation of termination.

Said preferential treatment including but not limited to:

· Failure to recommend termination of Mr. Thompson for multiple instances of job abandonment (failure to come to work with no notification to superiors) during the 2007-2008 academic year; and during previous academic years, both at SVHS and at other schools where he was employed; and, indeed during the current 2008-2009 academic year since he was (evidently) not suspended or being disciplined, and indeed, still being paid for the SVHS job position, although not present to perform his duties (other employees have been or would be terminated for this)

· Failure to recommend termination for repeated violations of State & County Acceptable Use of Internet policies as relates to his use of internet including posting of non-authorized photos of SVHS students on his private, personal website, copyrighting them, also linking the SVHS WVNet Website to his private, personal web-site with inappropriate links to adult content, where he solicited SVHS students lured to the site, to engage in non-school related chat or email him at his private, non-Access, email account. (students would have been suspended) (other employees have been or would be terminated for this)

· Failure to recommend termination for repeatedly taking pictures of SVHS students without standing (not related to job duties, not a club sponsor, not a teacher) and without administrator knowledge or approval, parental knowledge or approval or required signed release forms, generating many parent complaints and concerns. In conjunction, odd and inappropriate behavior around students and student activities, including hiding behind objects and emerging quickly snapping pictures, only to quickly hide again, trying to enter private areas where students were (dugouts, team areas) (students would have been suspended or expelled) (other employees have been or would be terminated for this)

· Failure to recommend termination for repeated incidents of insubordination for failure to comply with multiple written, documented requests from superiors as regards appearing for meetings, required performance & procedures, requests for passwords for all networks, hardware & software. (students would have been suspended) (other employees have been or would be terminated for this)

· Failure to recommend termination for Mr. Todd Thompson repeatedly carrying a weapon (a large knife) on his person, often on his belt, in plain view of faculty, staff & students and was heard to remark to one employee as to sic paraphrased ‘think what he could do to a man with this’ (students would have been expelled & criminally charged) (other employees have been or would be terminated/criminally charged for this)

· Failure to recommend termination after repeated incidents of harassment to students. (students would have been expelled & criminally charged) (other employees have been or would be terminated/criminally charged for this)

· Failure to recommend termination after repeated incidents of harassment to administrators, faculty & staff (students would have been expelled & criminally charged) (other employees have been or would be terminated/criminally charged for this)

· Failure to recommend termination after receipt of a copy of a rambling, disturbing, threatening email sent by Mr. Todd Thompson via Access email over WVNet suggesting Mr. Thompson’s mental instability & agitation, making threats toward specifically named SVHS employees, namely the principal, 2 assistant principals and a secretary. (Note: Superintendent of Schools, Gary Adkins and Assistant Superintendent of Schools, Mike Rutherford failed to notify the principal that an email was received, failed to notify the principal or the other three employees that threats had been made against them or that there was any cause for concern. The employees finally learned of the threats from an outside party in April 2008, the principal then contacting the Superintendent of Schools, Gary Adkins and asking for a copy of the above-mentioned email.) (student would have been expelled/criminally charged) (other employees have been or would be terminated/criminally charged for this

· Failure to recommend termination after Mr. Thompson harassed a parent (a disabled, paraplegic, wheelchair-bound, former firefighter) and filed a false battery complaint with the West Virginia State Police against said parent (other employees have been/would be terminated for this)

· Failure to recommend termination after Mr. Thompson filed a false Workman’s Compensation Claim (other employees have been or would be terminated/criminally charged for this)

· Failure to terminate after persistent and flagrant smoking on campus, during school hours and at school functions, in plain view of students and parents, continuing to smoke after being asked to stop by parents (students would have been suspended) (other employees have been or would be disciplined/terminated for this)

· Failure to recommend termination for working and driving on campus while under the influence (i.e. – sitting or standing in a stupor in and near the main office, incoherence, slurring words, loss of motor function/palsy, unsteady gait & staggering into and leaning against hall walls with eyes closed in front of faculty, staff, students & parents) (students would have been suspended or expelled) (other employees have been or would be terminated for this)

· Failure to terminate for not signing in, not signing out, leaving the campus, abandoning post and job duties without permission or notification, or turning in reduced hours for payroll purposes (other employees have been or would be terminated for this)

· Failure to terminate for requesting pay for days not worked, nor present (other employees have been or would be terminated for this)

· Failure to allow a SVHS principal to complete a personnel evaluation as is required, that would have quantified and qualified poor job performance to date, setting base point for plan of improvement, leading to termination, if proficiency not attained (Note: Direct intervention here by Superintendent of Schools, Gary Adkins, stopping evaluation mid-process)

· Failure to secure Mr. Todd Thompson’s personnel file which mysteriously disappeared after the above-mentioned principal took other employment.

· Failure to retain copies of all complaints and documents related to poor job performance faxed to the Superintendent’s attention by the above-mentioned principal, duplicates of the documents in the missing personnel file
Further:

We also protest Superintendent Gary Adkins gifting Mr. Todd Thompson with a five-month-long “special administrative leave” paid “vacation” with no suspension and no disciplinary hearings which, when asked about the “leave” by concerned parents, former BOE President, Mike Skeens, noted that sic paraphrased ‘News to me. Thought he was suspended. Administrative leave thing – don’t know. Evidently never been done before.’ This is certainly questionable and clearly preferential treatment as compared with any other employee.

We further protest our tax dollars being used to pay Mr. Todd Thompson’s “special administrative pay” since his departure from his job, April 2, 2008.

We continue to protest the past, and ongoing, intervention of Superintendent Gary Adkins and Assistant Superintendent Mike Rutherford, to keep Mr. Todd Thompson in his position, notwithstanding a long history of poor job performance, rendering the functionality of technology assets at SVHS seriously compromised during his tenure, impairing the education of all SVHS students, compromising the required delivery of CSO’s and implementation of multiple 21st Century Learning goals, across all subject areas.

Further:

We vehemently protest the failure of Superintendent Adkins and Assistant Superintendent Rutherford to:

as previously requested, take down Mr. Thompson’s bogus SVHS webpages which are posted to his private verizon.net website, which have a verizon.net url, which is hosted by a private (non-WVDE) internet service provider which, unbelievably, is still fully operational as of the date of this letter, some six and one-half months after its improper existence was brought to the attention of the Superintendent Adkins, Asst. Supt. Rutherford and the Wayne County Board of Education members, with the exception of Ms. Hurley.

which is still presented as an official Spring Valley High School website and which is still, unbelievably, displaying unauthorized pictures of SVHS students, with said photos purported to be “copyrighted” as the personal property of Mr. Todd Thompson with the following comments posted above and below them:
“All images are copyright to me, Mr. Todd Thompson, each image is invisibly watermarked with DigiMarc software, and visibly marked with the same. Although when scaled up the visible marcs color scale blew apart this morning, it is 5:00 am. All rights reserved. Copyright 2008.”

“I was amazed at this students skill at preforming this stunt, and my sheer luck at getting such a good picture of it! I give her an A+! Of course, I give all the girls an A+ too! All cheerleading pictures taken by a Nikon S-200 direct to SD storage media. You can click on each photo to take you to the full size photo.”

“These too are DigiMarc software tagged, and property of Mr. Todd Thompson. Copyright 2008, all rights reserved. Look for more photos to be posted.”

Further:

We vehemently protest the failure of Superintendent Adkins and Assistant Superintendent Rutherford to:

As previously requested, retrieve all photographs ( i.e. “hundreds”) of SVHS students from Mr. Thompson’s personal and school photographic equipment, any personal computers, or any digital storage media (SD or any other digital camera cards, flash memory devices (thumb drives), internal or external hard drives or media storage, etc.), which he had located at his home, on his person, in his vehicle, or any other off-campus location
“this morning, it is 5:00 am” “All cheerleading pictures taken by a Nikon S-200 direct to SD storage media”
“Look for more photos to be posted.”
This is very important to the parents of those children whose photos were taken, particularly those whose children’s images are now posted to this man’s private website.

With the exception of new Board Member, JoAnn Hurley, we also protest each Board Member’s past inaction, both toward Mr. Todd Thompson, and also toward Mr. Adkins and Mr. Rutherford as regards their inexplicable and indefensible actions or inaction, particularly Mr. Adkins’ failure to recommend termination at several points, particularly for repeated acts or actions, especially those endangering students.

In conclusion:

We respectfully ask again that Todd Thompson be removed from our school, Spring Valley High School, permanently, effective immediately.

We respectfully ask again that all exterior locks and specified interior locks at SVHS be re-keyed and all electronic access be reset.

We respectfully ask that the Wayne County Board of Education not employ Todd Thompson in any capacity, at any Wayne County school.

We respectfully ask that the Wayne County Board of Education insure Todd Thompson, and anyone related to Todd Thompson, have no access to school buildings, technology in those school buildings or access to students, faculty, staff; nor their records, likeness, or personal data.

We respectfully ask again that the Board ensure the webpages posted on Mr. Todd Thompson’s, that purport to be related to Spring Valley High School, be deleted and removed immediately, particularly the page with unauthorized photos of Spring Valley students.

We respectfully ask again that you retrieve all photographs of Spring Valley High School students, past and present, both prints and digital images stored on any cameras, digital media cards used in cameras, flash memory devices (thumb drives), computers, or any digital storage media, internal or external hard drives which Mr. Todd Thompson has located at his home, on his person, in his vehicle, or any other off-campus location.

We respectfully ask again that someone be placed in the position of Network Administrator who is fully qualified, with appropriate training and credentials, competent, possesses the necessary specific skills and extensive job experience, preferably outside this county, in the technical aspects of the job; further we request the job not be filled with anyone who is currently an employee at the Central Office, is related to anyone who is currently an employee at the Central Office or is related to any WCBOE member, or is currently employed as a Title I employee or, in any capacity, as a contracted employee (outside contractor) who is compensated with Title funds, particularly Title I funds, which is controlled by another relative of a Wayne County Board Of Education member.


Additionally:


We respectfully ask for the resignations of Superintendent of Wayne County Schools, Gary Adkins and Assistant Superintendent of Wayne County Schools, Mike Rutherford.

Their history of action and inaction, as regards this and other long-standing situations, constitutes malfeasance, misfeasance & nonfeasance and a pattern of violation of the public trust.

They have clearly failed, with intention, multiple times, to act upon the documented fears and concerns, requests for action, notifications of State Code violations, notifications of civil and criminal violations, notifications of the existence of a hostile work environment they have received from their own employees - the administration, faculty & staff at SVHS - who spoke out in spite of well-placed fears of retribution or retaliation.

They have clearly failed, with intention, multiple times, to put the safety, welfare and education of Wayne County students at Spring Valley High School first and have indeed, by their actions, placed these students in danger.

Dear Mr. Morris:

You are well aware of the multiple complaints weekly, sometimes daily, received as regards Mr. Todd Thompson’s actions, inaction, and interaction with students, parents, faculty and staff at your school.

It has come to my attention that Mr. Thompson has taken photos of SVHS students, minors, without your authorization, without parental consent or signed permission, retained said photographic images, removed them from school premises, published them to the internet on a private website, utilizing a private, non-academic internet service provider.

As administrator of Spring Valley High School, you may move, remove, and re-distribute county-purchased assets within your facility as you deem necessary and are expected to attend to daily safety and security matters as regards your facility as you deem necessary.

Therefore, the LSIC requests that you immediately remove all computer equipment, external hard drives, digital storage media, flash drives, all video cameras and equipment, and all other cameras, both digital and film-based, and any other items found in or in the vicinity of Mr. Todd Thompson’s office at Spring Valley High School and secure them until such time as they can be examined as relates to inappropriate actions involving the above-mentioned minor children.

We also request the locks for the office, server room, and related common areas such as the library be changed or secured until the area itself can be closely examined as regards images stored on network drives or other computers.

The LSIC will also request, via the Wayne County Board of Education, the return of any images personally retained my Mr. Thompson at other private locations immediately.

Gentlemen:

The LSIC of Spring Valley High School is very concerned about daily functionality issues regarding the SVHS network, computer labs, the library/media center computers, technology class labs, the laptop lab, classroom/faculty computers and the Channel 39 computer and uplink, among other things.

The daily maintenance, updates & back-ups, scheduling, (daily) Netware student record maintenance, multiple software management, assessment & troubleshooting, on-site problem resolution, hardware assessment & prompt submission of work orders that occur every day in a school that need the attention of a system operator/network administrator have not been addressed for some time at SVHS.

The proper functioning of the network and related computer equipment is essential to every single student, every day at SVHS, not to mention the administration, faculty and staff.

The LSIC learned on Friday, April 4th, that the former Network Administrator at SVHS, Sean Ferguson, is available for outside contract work.

The members of the LSIC request that Mr. Ferguson be employed as an outside contractor to fill this short-term but critical need for a specifically skilled individual to deal with the above-mentioned issues in Mr. Thompson’s absence.

We feel Mr. Ferguson to be a logical and practical choice during this period, due to his previous experience on site. Because of his familiarity with Novell Netware and the installations at SVHS, little time would be lost and no additional expense incurred during transition as might happen if someone unfamiliar with the school and its applications were employed and they required extra time or training to perform the relevant job duties.

Mr. Ferguson’s home phone number is 733-4185. The office personnel at SVHS have additional contact information for him, if needed.

It has come to our attention that an email sent on Wednesday, February 6th, 2008 by Todd Thompson was irrational and threatening, clearly indicating a possible threat to Spring Valley High School and its students, in general, and also to certain administrative staff, specifically named therein.

[Note: This email was sent from an access email account to multiple email addresses, including at least one access email account of a WCBOE Central Office staff member via the WVDE access email network/WVNET.]

In this rambling, irrational, threatening five-page email:

Please note: (sic) All misspellings are intended, enclosed in quotation marks as direct quotes and relevant to a verbatim transcription.

Mr. Thompson uses the words “violate/violation of my rights or my civil rights” eight times.
Mr. Thompson uses the word “defend” (as to myself or my rights) three times
Mr. Thompson refers to the United States Constitution five times.
Mr. Thompson refers to Freedom of Religion or religious beliefs five times.
Mr. Thompson uses the word “hair” fourteen times.
Mr. Thompson uses the word “they” sixteen times.

Mr. Thompson uses several hot-button phrases such as “until I draw my last breath” “stand up and defend myself” “Facist state” “BLATANT violation of my civil rights” “unreasonable search and siesure” “reached the end of my rope” “I will do what ever is necessary to maintain my right” “I have taken every kind of medication in the world”

Mr. Thompson singles out SVHS administrators Mr. Morris, Mr. Davis, Mr. Swann, and secretary, Cosbie Farley by name and refers to them two more times as the “4 of them”. It further mentions the administrators as the three of them or the other two at least two more times and then singles out Mr. Morris a third time by name, saying “his cupability (sic) is like double or tripple (sic) that of the other two.” Did law enforcement, assuming they reviewed this, construe this to be a de facto ‘hit list’?

Other items of interest:

“talked to 2 other employees who have long hair” – Were those 2 employees (witnesses) interviewed
as to their opinion as to state of mind/premeditation
of action, drugs?

“My desk has been searched and researched many times” - Why? When? By whom? What were the
results?
“I have taken every kind of medication in the world” – Intemperate condition in workplace/Drug-Free
Schools/Workplace documents? What drugs?
Drug test? Self medicate? Prescrips obtained
illegally, pot, crack, cocaine, meth? Appearance,
strange odors, strange nonsensical statements,
aggressiveness, particularly toward students,
loss of sense of time while in main office, loss of
fine-motor skills noted in workplace, seen
lounging/sitting on loading dock/custodial area at
rear of school, after school, smoking,
appeared to be an altered state




Rants that are particularly alarming:

“Are we quietly turning into a Facist state, where the bosses tell the little people what to do”

“I will do what ever is necessary to maintain my right”

“better not be bullying me, because I am on guard and will defend my rights under the Constitution, until I draw my last breath. I stand before you now not as just another person to be punted around for their glee and sick pleasure, so they can chuckle when I am dismissed from the room, but you see before you an American proud and strong, from Wayne County, who will stand up and defend myself against tyranny and deep seated long standing traditions that need to be changed because they are wrong and in conflict with the US Constitution”

“I am the only 1 who is being picked on, and that is blatant discrimination and creating a nonlevel playing field with forethought and malice”

“wrong, especially when done over months of time with great forethought and deepseated malice”

“and there fore we will pick on you, bedevil you, change your access level to the server, make you look like a fool, do just what ever we can think of to get you to cut your hair because we think it is wrong, or OUR pastor told us that it is wrong, and we need to straighten you out boy.”

“Shall I go on how over the past few years that I have been singled out for discrimination and violation of my civil rights?”

Note: Transition from multi-page third paragraph rant portion of email to last five paragraphs (which were short, non-descript, conversational, pleasant) was decidedly odd, abrupt, like switch flipping. No mention or acknowledgement of previous rantings, revelations, disclosures or issues discussed in the lengthy, single-spaced third paragraph diatribe, that when printed, prints to approximately 3 full pages.

The email was sent on February 6, 2008.

Items of concern as relates to the timeframe of receipt of this email:

On February 7, 2008, an adult entered Notre Dame Elementary School, in nearby Portsmouth, Ohio, armed with a handgun and knife, and attempted to kill an employee in front of a classroom of children. This individual had previously made written and verbal irrational, threatening statements and exhibited irrational, aggressive behavior prior to said act.

On February 14, 2008, an adult (medicated, highly educated, had been attending college for ten years) entered a Northern Illinois University lecture hall with three handguns and a shotgun and killed five, injured sixteen. This individual had previously made written and verbal irrational, threatening statements and exhibited irrational, aggressive behavior prior to said act. The shooter also made gun-related purchases before the shootings.

Note: It was found that the Northern Illinois shooter purchased weapons online from the
same vendor that the Virginia Tech shooter purchased weapons from.

Item of concern as relates to investigation and remedies as relates to receipt of this email:

Less than a week after the October 10, 2007 shootings at SuccessTech Academy High School, located in Cleveland Ohio, by a student who was previously known by administrators to be a threat, the Cleveland Public School District established a hotline for students to report threats and dangerous behavior, announced it was hiring armed security guards to patrol all campuses, installing metal detectors at all schools, and implementing additional security precautions at all schools to be reviewed by an outside professional security firm.



The members of the LSIC are gravely concerned about this email.

Even to the untrained eye, the writer of this email seems to have a skewed perception of reality, a problem with perspective as regards routine everyday comments or occurrences, and feels very persecuted. The email seems to indicate the writer appears to be deeply paranoid and terribly over-reactive, obsessed with hair, obsessed with protecting or avenging perceived rights against perceived attacks or infringements or offenses, and also seems to be immersed in defensive, ultra-right-wing, Constitutionalist rhetoric.

Please document the date, manner of, and results of the investigation regarding this email.

  • Who assessed the threat level and profiled this email as to drug use, mental state, propensity to violence and criminal intent?
  • What law enforcement agency/agencies was this email forwarded to for review and assessment? On what date(s)?
  • Was a multi-state background check performed on Mr. Thompson to learn if he had any undisclosed citations, arrests, convictions, warrants? When?
  • Were database checks performed to learn if Mr. Thompson has been buying weapons within the last 12 – 24 months? When?
  • When was this email forwarded to the WCBOE’s attorney? Did he render any opinion regarding action required? Was the opinion followed?
  • When was the WVDE informed of the inappropriate access email transmission via WVNET?
  • What is/was their (the WVDE) position/participation in this matter?
  • When was the principal of SVHS informed about the email? A copy of that letter would be helpful.
  • When were the two SVHS employees with long hair interviewed? Did they express fear or concern? Was it considered that either of these two individuals could be Mr. Thompson’s drug connection/customers? Was that investigated?
  • When were the SVHS administrators and secretary who were personally named in the email warned of the threat? A copy of that letter would be helpful.
  • What extra measures were taken at the school to ensure student, faculty & staff safety?
  • Was Mr. Thompson tested for drug use? When?
  • Why was Mr. Thompson not suspended at this time?

We appreciate your prompt and complete response as regards this urgent situation.

The fourteen bulleted areas above represent questions regarding procedure and remedy. We are very interested in the actions of Central Office administrative personnel and the WCBOE, assuming the board members reviewed said email and were fully apprised of all related activities following its receipt by Central Office staff.

You will note we do not ask any questions which could be avoided by utilizing the “it’s a personnel matter and cannot be discussed” answer. Particularly, we do not inquire about what opinion the attorney rendered, only if one was rendered and if it was followed. We do not inquire as to the results of any drug test regarding specific personnel; we ask only if the procedures followed included a request and compliance for testing. Obviously, the Board did not suspend Mr. Thompson, so it is certainly reasonable to inquire as to justification for that decision.

Gentlemen:


The LSIC of Spring Valley High School is very concerned as regards the matter that was brought before you during Executive Session at the April 1, 2008 Board of Education meeting.


We have received no communication from you these past two weeks as regards this urgent matter.


The parents of many children at SVHS are very concerned. They wish to know if the images of their children that were at Mr. Thompson’s private residence and on various electronic or photographic equipment at his private residence or elsewhere other than school grounds have been recovered and are in your possession.


When was this equipment seized? When will the parents be notified of the recovery of these images?


Also, we are concerned as regards written threats found in Mr. Thompson’s office with specific children’s names attached. Have the police determined this to be a possible “de facto” hit list? With this new threat, we request all exterior locks at SVHS be changed.


The LSIC would like to be informed as to the progress of these multiple investigations.

Letters Received by the SVHS LSIC

This is a copy of a letter given to the SVHS LSIC when the LSIC requested proof that a frightened student's complaint made to a member of the SVHS LSIC about Mr. Todd Thompson's abusive physical and verbal behavior towards her and another student had been addressed properly.

Mr. Adkins,

We have identified another situation regarding items in Mr. Todd Thompson’s office as regards his contact with Spring Valley High School students.

A female student had previously complained anonymously to a secretary who is an LSIC member about Mr. Thompson’s verbal abuse and actions toward her and another student but was too frightened to sign a written complaint. She also stated she wanted to start a petition to have him removed from our school but again was too frightened.

Since Mr. Thompson’s absence, she handed in a written statement but was still too frightened to sign it. I added this statement to the large file of complaints which I have kept on Mr. Thompson.

Today, I realized that an angry, threatening message written by Mr. Thompson on the back of a magazine I noticed laying in his office, referred to this child and another student by name.

I wanted you to be aware of this new information.
